After the Event (ATE) insurance is a Legal Expenses insurance policy that protects an insured against their exposure to the opponents’ legal costs, should their case be unsuccessful. 

Indemnity can extend to include own disbursements such as court fees, expert fees, and counsels’ fees. Insurers can consider all manner of disputes, typically where damages exceed the costs budget to trial.

Litigation funding, sometimes referred to as third-party litigation finance is a non-recourse funding agreement. Funders will fund all or part of a claimants’ legal fees in return for a share of the damages. Funders will usually require the proposer to obtain suitable ATE insurance, as a condition of any offer of funding.
